What is the “mommy crack”?
Unfortunately, the system is not perfect. Not everyone who is disabled is eligible for benefits. One of the most common exceptions to eligibility is the “mommy crack”.
In a typical situation, a parent takes time off work to raise the children. Shortly after his Title 2 “insurance” lapses, when the children are old enough to take care of themselves in the afternoons, she returns to the work force, but before she has worked long enough to be fully insured again, she has an on the job injury and becomes disabled. There is no question that she is medically disabled, however because she is not fully “insured” she cannot get Title 2 disability and because her spouse earns too much money she cannot get Title 16 benefits, due to the level of household income.
